Access to path...... is denied

I'm sure this is a cockpit error, but I cannot seem to solve it. I have tried running as admin, etc, all without luck. When eraser empties the Recycle bin, it says completed with errors, always. The error log shows:

and

Sunday, November 11, 2012 4:40:10 PM Error The file C:\$RECYCLE.BIN\S-1-5-21-1116670782-2342522905-882804739-1000\$RRHOQU5.lnk could not be erased because the file's permissions prevent access to the file.

Running Win7 Ultimate, 64bit, latest set of updates....

What am I doing wrong????

What happens if you manually empty the recycle bin? Also are you the only user of the PC? It could be another user account owns those files.
 
A manual empty of the bin functions normally.
I am the only user of this PC.
I am the admin.

If I leave the file in it's folder (not putting it in the Recycle Bin) , and perform the erase from there, it works fine.

I'm so used to moving 'stuff' to the bin that I forger to 'erase' in place...

I did discover that it does not fail on Win XP (my workshop machine), but does fail on Win 7 (Main machine)
Anybody out there have an idea?
